Recently, an ex-Supreme Court Judge was appointed to the post of Governor in Andhra Pradesh- marking the 3rd such appointment of former apex court judges to high profile postings since 2014. This has raised debate on the implications of such post-retirement appointments.
How do post-retirement appointments work?
- There are 2 ways in which such post-retirement appointment of Judges are made.
- Some offices statutorily require the appointment of a Judge of the Supreme Court or a High Court. Eg: appointments to NCLAT, National Green Tribunal and other quasi-judicial bodies.
