Supreme Court to Rule on Bribery Law

The Supreme Court of India is set to determine whether offering a bribe, even if declined by a public official, constitutes a punishable offense under the Prevention of Corruption Act (PCA), 1988. This case, stemming from a 2016 bribery incident in Orissa, challenges interpretations of the law before its 2018 amendment, which explicitly criminalized bribery offers. The PCA penalizes corrupt practices by public servants and others, with amendments in 2018 and 2021 strengthening anti-corruption measures. The court’s ruling will clarify abetment laws under PCA, affecting ongoing cases and setting a precedent for corruption jurisprudence.
