New Appointment Process for Election Commissioners

The Chief Election Commissioner (CEC) and Election Commissioners (ECs) are now appointed under the 2023 Act, introducing a Search Committee led by the Law Minister. This committee shortlists candidates for a Selection Committee comprising the Prime Minister, a Cabinet minister, and the Leader of the Opposition. The new law also allows candidates from outside the Election Commission, ensuring broader selection but raising concerns about potential biases. Triggered by a Supreme Court ruling for checks and balances, this legislation excludes the Chief Justice of India from the Selection Committee. The upcoming CEC selection will test the Act's effectiveness in preserving impartiality.
